xAI Faces Legal Action Over Memphis Data Center Pollution

Elon Musk's artificial intelligence firm, xAI, is facing a lawsuit over air pollution stemming from its Memphis, Tennessee data center, known as "Colossus." The Southern Environmental Law Center (SELC), on behalf of the NAACP, issued a 60-day notice of intent to sue, alleging violations of the Clean Air Act.

The lawsuit centers on xAI's use of at least 35 gas-fired turbines to power the facility before a grid connection was established. SELC claims these turbines are emitting harmful pollutants, including nitrogen oxides and formaldehyde, without the necessary permits.

The SELC alleges that xAI failed to respond to multiple formal requests from the local health department to address the pollution. Furthermore, the company allegedly failed to implement required "Best Available Control Technology" to mitigate emissions.

Environmental Injustice in South Memphis

The Colossus data center's location near a predominantly Black community in South Memphis raises concerns about environmental justice. The NAACP statement highlights the existing poor air quality in the area, exacerbated by the data center's emissions. The organization is seeking injunctive relief, civil penalties, and costs.
