Ian Balina, CEO of Token Metrics and a prominent YouTuber with over 100,000 subscribers, announced that the US Securities and Exchange Commission (SEC) intends to recommend dismissing the lawsuit filed against him in 2022. The suit alleged violations of securities laws related to his promotion of Sparkster (SPRK) tokens during a 2018 initial coin offering (ICO).
Balina claims the SEC’s decision stems from a shift in administrative priorities following the change in leadership. He attributes this to the new administration's purported pro-crypto stance.

The SEC's complaint alleged Balina received a 30% bonus from Sparkster on a $5 million token purchase, a fact he allegedly failed to disclose to his followers. A May 2024 court ruling declared SPRK tokens to be securities under SEC jurisdiction. Balina's legal team had planned to appeal this decision.
While Balina states the SEC will recommend dismissal, at the time of publication, no official court filing reflects this. The SEC declined to comment on the ongoing case.
