Crypto Lobby Pushes for Developer Protections in US Crypto Bill

Leading US crypto lobbying groups are urging lawmakers to include safeguards for software developers and infrastructure providers in upcoming crypto regulations. A joint statement released on June 5th by prominent organizations including the DeFi Education Fund, Coin Center, and the Blockchain Association, calls for the inclusion of the Blockchain Regulatory Certainty Act (BRCA).

The BRCA aims to exempt developers of non-custodial crypto platforms from being classified as money transmitters. This is crucial, the lobbying groups argue, because developers of peer-to-peer software and decentralized network infrastructure are fundamentally different from traditional financial institutions and shouldn't face the same regulatory burdens.

This push comes as lawmakers consider the Digital Asset Market Clarity (CLARITY) Act of 2025, which seeks to redefine the roles of the SEC and CFTC in regulating digital assets. The lobbying groups advocate for adding the BRCA as an amendment to the CLARITY Act.

Concerns Beyond Money Transmitter Classification

Coin Center communications director Neeraj Agrawal highlighted another key concern: the risk of unconstitutional surveillance requirements being added to the legislation. The lobbying groups are actively monitoring this aspect to ensure developers' rights are protected.

Shifting Regulatory Landscape

The US government's approach to crypto regulation is evolving. SEC Chair Paul Atkins recently stated that the days of regulating through enforcement alone are over, signaling a shift towards collaboration with industry stakeholders.

The Senate's upcoming decision on Brian Quintenz's nomination to lead the CFTC is also significant. Quintenz has publicly disclosed $3.4 million in crypto assets, indicating a potential for more nuanced understanding within regulatory bodies.
